Terms of Service

1. Scope and Provider
These Terms of Service (“Terms”) govern your use of the “SnapCard Ninja” web application (“Service”).

2. Service Description
(1) The Service enables (a) creating digital flashcards from uploaded images and (b) solving worksheets/tasks (“Solve”) via AI processing.
(2) Credit system (controlling contract terms):
- Pro plan: 300 credits per billing month.
- Consumption: 1 credit per processed image (flashcards); 2 credits per Solve job.
- Allotment/Reset: Credits are granted at the start of each billing month and expire at the end of the billing month. No cash-out or transfer.
(3) Free tier (if offered): As displayed on the product page. Free-tier allotments may vary.
(4) Marketing statements (“up to …”): Phrases like “up to 25× higher (than Free tier)” used in the app or landing pages are illustrative only and refer to typical Free-tier allotments. The definitive entitlements are the credit amounts set out in these Terms and the credits shown in your account. In case of discrepancy, these Terms and your account balance prevail.
(5) Generated sets are stored in your account and can be renamed/deleted.
3. Accounts & Minors
(1) Registration required (email/password or Google login). Information must be accurate and up to date.
(2) Children: Not directed to children under 13. Users aged 13–17 may use the Service only with parental consent; we may request proof.
(3) You are responsible for safeguarding your credentials.
4. Prohibited Use / Moderation
(1) Prohibited: unlawful content (including IP/privacy infringements), CSAM, hate/violence, fraud, spam/abuse, automated mass uploads, security circumvention, reverse engineering, service disruption/overload. We may review, restrict, or remove content upon reasonable suspicion. A notice-and-action channel is available for reporting allegedly illegal content.
(2) Users are responsible for their content and its legality. They commit not to upload or distribute prohibited content.
(3) The use of VPNs for general purposes as well as to circumvent the generally applicable restrictions is prohibited and may lead to account deletion.
(4) The provider may review, block, or remove content if there is sufficient suspicion of legal violations or breaches of these Terms; information will be provided to affected parties as legally required. A reporting channel (Notice-&-Action) for allegedly illegal content is available.
5. Content & Licenses
(1) You retain ownership of your content. You grant us a worldwide, non-exclusive, royalty-free license to host, process, cache, display, and secure your content to operate the Service.
(2) AI output: may be inaccurate; you remain responsible for verifying results (especially in educational contexts).
(3) We do not train our own models on your content. Third-party providers (e.g., Azure) process content to deliver the Service; see the Privacy Policy.
6. Pricing, Payment, Term, Cancellation
(1) Pro: €9.99 per month (tax-inclusive where applicable), processed by Stripe.
(2) Term/Renewal: Monthly; auto-renews until cancelled.
(3) Cancellation: Any time, effective at the end of the current billing month, via the in-account “Cancel now” button (or equivalent). Unused credits expire at period end.
(4) Payment issues: Pro features may be suspended upon failed payments.
7. EU Right of Withdrawal (Consumers)
(1) EU consumers have a 14-day withdrawal right.
(2) If you subscribe to Pro, you automatically request immediate access and therefore acknowledge loss of the right once performance begins and agree to the ceased right upon activation.
8. Availability; Maintenance
Best-effort availability; 100% uptime is not guaranteed. Maintenance windows and outages may occur.
9. Fair Use and Rate Limits
To protect the Service, fair-use, rate, or security limits may apply (e.g., per minute/day/month). They aim to ensure stability and prevent abuse and will not be applied to unduly disadvantage legitimate users.
10. Liability
Unlimited for intent/gross negligence and for death/personal injury; otherwise limited to typical foreseeable damages where mandatory law applies. No liability for third-party content or AI errors beyond statutory obligations.
11. Violations; Suspension/Termination
We may suspend or terminate accounts for material/repeated breaches (e.g., abuse, bot traffic, limit circumvention). Where reasonable, we warn first. Prepaid fees are not refunded unless the suspension was unjustified.

13. Changes to the Terms
We may modify these Terms for valid reasons (law, technology, features) with prior notice and a right to object or cancel. Changes to Free-tier allotments are reserved; the Pro entitlement (300 credits/month) will not be reduced during a period already paid.
14. Governing Law
German law applies; mandatory consumer protection of your habitual residence remains unaffected.
